Terms of Service
1. About Lyve
Lyve is an AI companion application developed by AISmart (ai-smart.ca). The service includes:
- A mobile app that passively senses context (activity, location type, social environment, emotional state) from your device.
- An AI companion named Liv that generates post drafts, daily recaps, and a bio in your voice based on your sensed context.
- A social feed where you can publish, approve, and interact with posts.
- A waitlist website where prospective users can register interest.
These Terms govern all of the above. By creating an account, joining the waitlist, or accessing the app or website, you agree to be bound by them.
2. Eligibility
You must be at least 13 years old to use Lyve. If you are between 13 and the age of majority in your jurisdiction, a parent or legal guardian must have reviewed and agreed to these Terms on your behalf. By using the service you confirm you meet these requirements.
3. Beta Status
Lyve is in beta. The service is provided on a best-effort basis and may be interrupted, changed, or discontinued at any time without notice. Features described on our website may not yet be available, may behave differently in the app, or may be removed. We are not liable for any loss arising from beta-stage interruptions or changes.
4. Your Account
- You are responsible for maintaining the security of your account credentials.
- You must not share your account with others or create multiple accounts.
- You must provide accurate registration information and keep it up to date.
- If you believe your account has been compromised, notify us immediately at privacy@ai-smart.ca.
5. Context Sensing and Permissions
Lyve requests device permissions (location, motion, camera, notifications) to operate. You control which permissions are granted. Revoking a permission disables the corresponding feature. The data collected by these sensors is described in detail in our Privacy Policy.
You acknowledge that context sensing operates in the background and that the inferences Lyve draws (activity, location type, emotional state) are automated estimates that may be inaccurate. You retain full control: every generated post requires your approval before it is published, unless you explicitly enable autopilot mode.
6. AI-Generated Content
Posts, bios, recaps, and companion messages produced by Lyve are generated by AI (powered by OpenAI) based on your sensed context and preferences. You acknowledge that:
- AI-generated content may be inaccurate, incomplete, or not reflective of your actual views.
- You are responsible for any content you choose to publish, whether written by you or approved from an AI draft.
- By publishing a post, you represent that you have reviewed it and consent to its content.
- We do not guarantee the quality, accuracy, or appropriateness of AI-generated output.
7. User Content
You retain ownership of content you create and publish on Lyve. By posting content, you grant AISmart a non-exclusive, worldwide, royalty-free licence to store, display, and distribute that content within the Lyve platform as necessary to operate the service. We do not claim ownership of your content and will not use it for advertising.
You are solely responsible for the content you publish. You agree not to post content that:
- Infringes any third-party intellectual property or privacy rights.
- Is unlawful, defamatory, harassing, threatening, or abusive.
- Contains malware, spam, or deceptive material.
- Violates the rights or dignity of other people.
8. Acceptable Use
You agree not to:
- Attempt to reverse-engineer, decompile, or tamper with the Lyve app or API.
- Use automated scripts or bots to interact with the service.
- Attempt to access other users' accounts or data.
- Circumvent any technical measures we implement to protect the service or users.
- Use the service to facilitate illegal activity.
Violations may result in immediate account suspension or termination.
9. Privacy
Your use of Lyve is governed by our Privacy Policy, which is incorporated into these Terms by reference. It explains in full what personal data we collect (including location, GPS, sensor signals, and AI-processed context), how we use it, and the third-party services involved (OpenAI, Google Places, Google Cloud Storage, Expo, Open-Meteo).
10. Third-Party Services
Lyve integrates with third-party APIs to deliver its features. Your use of Lyve constitutes acknowledgement that data may be shared with these providers as described in the Privacy Policy. We are not responsible for the practices of third-party services.
11. Intellectual Property
The Lyve name, logo, app design, and all content produced by AISmart are owned by AISmart and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our trademarks or branding.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
- The service will be uninterrupted, error-free, or secure.
- AI-generated content will be accurate, appropriate, or suitable for any purpose.
- Sensor inferences (activity, emotional state, location type) will be correct.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AISMART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR REPUTATIONAL HARM, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
14. Indemnification
You agree to indemnify and hold harmless AISmart and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your posted content, or your violation of these Terms.
15. Termination
We may suspend or terminate your account at any time for violations of these Terms. You may close your account at any time by contacting privacy@ai-smart.ca. Sections covering intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days in advance. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
